If you trust the prosecution, Microsoft is guilty of labeling computers as "Windows Vista Capable" when they really can only run the basic edition of Windows Vista. While this sounds like an absolutely ridiculous reason to sue Microsoft, it is a very legitimate case. Microsoft labels almost all new computers as "Windows Vista Capable", which makes users think they are buying all the cool stuff that's advertised in the "Windows Vista Experience", such as Aero. In truth, users can only run the basic edition of Windows Vista, which comes with no such luxuries. The defense (aka Microsoft) claims that this is really not the case, and that "Windows Vista Premium Certified" is just one way to prove that Microsoft "conducted a very broad and unprecedented effort" to educate everyone on the latest version of Windows.

Seriously but microsoft needs to start providing smother operatiing systems and where is his security its like he is getting his advice from rumsfield... instead of feeding us thechies with bugs, he needs smother aplications which is rare to see with high end multimedia applications...... it leADS to better progress instead of fatter wallets for Mr Bill gATES....... Gates says it all he controls our money to better our over spurt population, If we gave everyomne money we would not be able to buy anything cause we would be to busy trying to buy stuff and no one to make it or you make yopur own what this means I dont know but please try to get the jist of it i will further reasearch the tyrant of software and see why the people are so easily mislead example ever go to Mcdonalds and eat a big mac and when you are done and you drive by the next mcdonalds up the street you want another one ....the easy deciption of the mind is a powerful thing and some one must be controling it??????

why does my 7300gt only produce 100 mp/s fillrate but xp its 326mp/s ...I'll tell you why cause billy is providing a reason to move to quad core even if we might not respectivly need it but still charging us mislead at a premium...

Any machine that can run XP at a reasonable speed can run vista with the effects turned off. People whining over Vista is getting old, especially when you can tell that they arent using it, and havent tried it.

She actually makes alot of sense for this. For something to say Windows Vista certified, only to be limited, is a bit misleading. Microsoft should have been more forthcoming with its clarifications. Granted, its kind of nutty to sue about this, but, in America, you can sue for anything.

First off; I dought the judge knows what a GPU is.
Secondly; seldom does the consumer Loose. MS will probably settle "out of court" giving the woman a new computer, or a coupon for one.

capable, it can run vista basic, my laptop says vista capable, but it runs vista with aero etc perfectly fine...people expect a 400 buck machine to run aero and all the nice stuff.....i like to call those people ignorant

My dad's AMD Duron 1.2 GHz Sck-A, 1GB PC3200 Value and GeForce FX5200 is "Windows Vista Capable". It's running Vista Ultimate with the Aero3D interface and has a performance index of 2.5. Nearly any computer is "Windows Vista Capable".
What that lady needs to understand is that you're not going to get a fast computer for $300 USD. You're going to get a Celeron/Sempron with onboard everything. People like this get mad when they buy software without checking hardware requirements. They expect a video input/output to magically grow out the back of their e-machine when they buy Adobe Premiere.
I would have better luck trying to get money out of Microsoft because their built-in nForce3 RAID drivers don't work.

I'm pleased this case has come to light... not that the particular woman is due millions... but that Vista Marketing is truely f'ed up with more than 100 versions, etc. etc.

XP was complex enough with all those Home and Business editions, but Vista is way too complex a "purchase experience".

I hope MS kills "basic" and gives all "basic" users a free upgrade to premium.

P.S. I don't care too much for Vista, but I do think the market is better served though product simplicity.

Vista comes in different versions. There are many resources (not to mention sales people) to help you find the Vista that suits you best (not to mention a computer that matches it). Making Windows Vista Ultimate the one and only Windows Vista would be like making anyone who wants a car buy a Lamborghini. Some people only need (and can afford) a Pinto. She wants a Lamborghini for the price of a Geo Metro. It's not going to happen, lady.
What this woman is saying, I should also be able to sue the auto industry because my 91' Ford Escort isn't as fast as as a Jaguar, Lamborghini, Ferrari, Saleen, Viper, etc. by making the assumption that since "In general, cars are fast." that therefore "All cars are fast."
She's assuming that since "In general, computers are fast." that therefore "All computers are fast."

In my personal opinion, those "Vista Capable" stickers are hardly a marketing strategy.

Nearly any computer younger than 3 years old can run Vista Ultimate anyways.

Ah, both of you (Completely Bonkers and XVI) are right. Times like these are when I just relax, just go with what I know, and let the courts decide who gets the money. If she wins, it's not like Microsoft isn't going to make that money back really quickly. Bill Gates (used to) make $13 million dollars IN HIS SLEEP (aka every night Microsoft's net worth would go up $13 million USD).
