Microsoft Faces Second Class Action Lawsuit Over Scratched Discs

Microsoft faces a second class action lawsuit in California similar to the lawsuit in Florida last week.
The suit alleges that

Microsoft improperly and/or negligently manufactured the Xbox 360 console in a manner that causes the expensive game discs ... to be scratched, rendering the games unusable

The complaint was filed Monday in the U.S. District Court for Southern California by Christine Moskowitz and Dan Wood. The suit is seeking not less than $5 million in damages for Xbox 360 buyers affected by the alleged glitch.
Moskowitz says that in March 2006 she purchased for her son an Xbox 360, along with the popular games Gears of War, Crackdown, and Saints Row. Within a few months, the games bore circular scratch marks and wouldn't work properly, Moskowitz claims. Wood says he purchased an Xbox 360 last December and the unit soon damaged his copy of Tom Clancy's Splinter Cell. Moskowitz and Wood argue that Microsoft's scramble to get a next-generation video game system into the market to compete with those from rivals Sony and Nintendo is at the root of the Xbox 360's problems.

Microsoft's rush to market, while positive for Microsoft, was detrimental to consumers because the Xbox 360 suffered from numerous hardware defects

A Microsoft spokesman as a reponce said that the company has not received a significant number of complaints about scratched discs, despite the fact that there are millions of Xbox consoles in use.

5 Billion dollars? That is ~~fucking~~ very lame, seriously, they sue just to make more money than their net worth. Geez the court should be able to cancel the court case with these types of lame things.

It's 5 million, not billion. And this is a class action lawsuit. If won, that money gets split up between all the people that claim the 360 damaged their disks, not just the plaintiffs in this particular case.

that was probably due to dirt/dust in your PS2 unlike the situation with the 360

This happened with the PS2 on release. Never heard of any class action lawsuit though.

Stop stop stop!

If you've ever contacted Sony or Microsoft while out of warranty, all you have to say is "My system is considerably slow, games do not read hardly at all. I've also noticed that my Sony developed (or if speaking with Microsoft, you say Microsoft) games have been scratched by the dying console."

You stress to them that THEIR console has damaged THEIR games.

This is a double negative, and in eight of eight attempts by friends and colleagues, we have gotten them to wave any and all fees, and refurbish the consoles. They also offered the same service for the game discs.

I know they don't always comply, but to throw down a lawsuit...well, I cannot support one in this case.

LoL, I know several people with 360's as well and as many problems as they have this isn't one of them.
