RTX 3070 ASUS Turbo fan is on 100% constantly but MSI Afterburner and any other app are reading 0 RPM

So as the title says my RTX 3070 ASUS Turbo fan is running at 100% while any app that can effect or read fan speed reads 0 RPM or 30% fan speed, the only time that it's not at 100% is when on the BiOS screen or disabled. I've so far tried these solutions:

• Updating/Changing Drivers
• Wiping my OS
• Changing the BIOS on the graphics card itself (Will note that 3070 Turbo BIOS from this site had model number mismatches and didn't work/display at all once installed which is odd/suspicious)
• Taking apart the card and making sure the connection to the fan is secure
• Changing the BIOS PcIe settings from Auto to Gen 3
• Reseating the card and 6+2 pin power connectors

One extra thing to note is that this card came from a seller on eBay and I got it for $213 on auction (A too good to be true price) so that could play some role/factor in this, and I am also currently going through the return process, just trying to see if I can get it to work before I fully give up. Any help would be incredibly appreciated

So I'm assuming return is basically my only option?
