Honestly, she could have shared them without knowing it... her kids could have installed Kazaa (a lot of the people using kazaa are kids). She could own the CD's and simply have ripped them to her hard drive so that she could listen to them from her playlist. I think Kazaa searches for files when it is installed, and tries to set itself up so that it starts up with windows....... so, she could have been doing simple web browsing or word processing while Kazaa was allowing others members to download her legit MP3s.

I also agree that those fines are way to high. What a joke. I guess all those kids that burn a copy of a music CD for their friends are going to be doomed for life once they are caught. :wtf:

well i believe they clearly showed she was uploading them and not just unknowingly sharing files that she downloaded. i dont think she was wrongly convicted but i think convicting her was wrong. even worse is the size of the fine!

if me or you won a case against the record companies for overpricing cds we would be limited to only collect the amount of loss, peanuts! the amount of loss they are allowing to be claimed here is out of line because they are treating her as though she was selling her own cds. in effect $1 for every person who downloaded her song.

this says loud and clear to anyone who shares files on the internet you "are" breaking the law but jaywalkers are not put in jail and file sharers should not be saddled with lifelong debt that ruins families. the wife and kids of some idiot sharing files shouldnt have their future ruined by it.

So, is it illegal to download 1700+ songs? Or is it just illegal to upload songs?

As a kid I use to tape my favorite songs from the radio station onto cassette tapes. If my friends wanted a copy of the cassette, I would make them a copy. Now that I am older, I really do not care all the much for the music industry. I rarely buy music CDs and get enough music enjoyment by listening to the radio while driving. I wish I could go back in time with the knowledge I have now, because I spent a lot of money on music cassettes that are now sitting the the storage room... of course, once CDs came out I had to go out and update my favorites by buying the CD. Anyway, my point is that the people might be downloading and sharing songs... but is that really hurting the music industry as much as they think... I have a hunch that the guilty people have a large collection of LEGAL music just as I did. They ARE supporting the industry as much as their income allows... but they simply can not afford to buy everything they like.

yes, it is just illegal to upload songs, but also illegal to copy cds or dvds, even if its for you to have a backup disk

Well backing up vidio's \ movies to CD \ DVD is not illeagel so why would games be ?

this is no different than someone buying a pack of cigerettes, you ask for one and he gives it to you, he goes to jail for it because he stopped you from having to buy your own pack!

the only difference is the record companies paid off the politicians to call free will a crime.

anything i own i can freely give and nothing i buy i do not own no matter what a crooked politician says. the arguement that i cant resell the song on the cd i buy makes sense and protects intelectual properties but to extend that to say i cant freely share it for free is crazy. but the law is the law and we must live with it.

they are not going about it the right way, they should make the internet illegal unless you have a goverment santioned website that is licensed and regulated for only goverment approved content. that would solve the problem once and for all, we should have that in about 10 years at the rate things are going.

all it really does is say if your in america you cant share files so download em and save em in your protected files.

now how much real impact will that have on file sharing? i think very little.

Nope, it's like the EULA on a video game. If it has a copyright, then you are purchasing the right to hear that song, not own it. You didn't buy the song, you bought the right to listen to it and when you purchase it, you agree not to make a copy of it. The purchase is a binding contract and you have to follow the rules of that contract.

It's the same thing with a book, you buy the right to read the words, not copy them and resell it. You can transfer your license to someone else, but you can't retain the book.

I know what I am doing because I have a copyright on a video tape and I had someone copying and reselling it.

No copyrights make it NOT yours sadly and if some one takes programs though file sharing you are responisble for that too.

Kinda like if a thief breaks in to your house and herts him \ her self you are responisble for that even too these days.

When stealing music, no matter how much, you have to accept that you are doing something illegal and will have to accept the consequences for any legal issues that arise.

I mean this could happen to anyone, but because she is a single mother doesn't make me feel sympthay for her. :(

9 out of 10 people saying she deserved it have commited the same crime. they have songs they downloaded for free, lets be honest we all do it, just to a lesser degree. this crazy woman was asking for it by sharing her whole 1,700 song collection to the world. maybe she never thought she was doing anything wrong, maybe she never realised they were constantly being downloaded because her computer was always on? who can say for sure what her intentions were?

all i know is that from now on people will think twice about sharing files freely and they will be moved to membership sites in ubekistan somewhere out of the reach of the us nazi party and not one less song will be downloaded so why bankrupt this woman and ruin her kids futures just to make a point?

Hehe, in Texas, you have the right to defend your home. If a guy breaks in and I knock him out, drag him to the basement, torture him till death and then call the cops, I was defending my home lol.

Hehe, in Texas, you have the right to defend your home. If a guy breaks in and I knock him out, drag him to the basement, torture him till death and then call the cops, I was defending my home lol.

Indeed.....here in AZ we still can carry exposed weapons, as our precious 2nd amendment preserves. Its amazing how polite society is when the threat of deadly force is ever present. I still contend that the tragedies of 9/11 would have never occurred had all passengers practiced their 2nd amendment right to bear arms - even tasers would have been better than nothing against a box cutter....geeez!

I'm gonna echo the opinions of many on here. If she did, in fact, get caught sharing songs, then , yes, she should have been found guilty.

But the penalty far outweighs the crime. There is absolutely no justification for the amount ordered. None what so ever. This is a sad day for the US Justice system indeed.
