Rockstar Reaches Hot Coffee Settlement

Rockstar Games has now managed to reach a settlement over the infamous "Hot Coffee" dispute which allowed gamers to unlock explicit content in Grand Theft Auto: San Andreas. Customers who still have the original disk and a detailed store receipt can claim up to $35 in compensation, and those with just the disk but no receipt will still be able to claim $5.
Defendants do not dispute that the parts that were modified and combined to display the Hot Coffee content were present in the code of the game discs. However, Defendants vigorously deny each and every allegation of improper conduct, and they deny all liability. The notice and other settlement documents provide information about the lawsuit, the settlement, your legal rights, what benefits are available, who is eligible for them, and how to get them. This is crap, just like suing the hard drvie makers for a problem with formats. You had to actually try to get the hot coffee mod to work, and then they released a patch to prevent it. Plus are the kind of people who buyt this game gonna be offended by some sim sex? Really can you imagine: In a happy church the nuns bought GTA:SA for the sunday school kids to play on the churches PC and little timmy finds the hot coffee mod on the internet and installs it, and after beating down thugs, fucking whores, running down gang menbers and popping caps at pigs he gets offended that he can see some digital nipple.

HOW YOU GET SETTLEMENT BENEFITS — SUBMITTING A CLAIM FORM

In order to receive any benefits – a replacement disc and/or cash – you must file a Claim Form and swear under penalty of perjury that you:

-Bought a Grand Theft Auto: San Andreas First Edition Disc before July 20, 2005;
-Were offended and upset by the ability of consumers to use third party software and/or hardware to modify and alter the Grand Theft Auto: San Andreas First Edition Disc to display the Hot Coffee content;
-Would not have bought the Grand Theft Auto: San Andreas First Edition Disc had you known that consumers could modify and alter the game content; and
-Upon learning the game could be modified and altered, would have returned it to the place of purchase for a refund if you thought this was possible.
Damn i failed on the last 3 points.
DaMultaAnd this is why GTA4 will not come out on PC....
Nah it will. They will simply make sure this doesnt happen again. I think this ruling is a bit harsh. They should simply have been fined a lump sum towards a charity or something.

Anyone who bought it online can very easily get detailed reciepts.

now you guys know you can do whatever you want, but if you ask me, dont return the game for 35 bucks just because you can. if you enjoyed it then keep it or just exchange it for another game. returning it for 35 bucks encourages people to get lawyers and file retarded lawsuits.

I've got a copy, and I'm sure I could dig up my receipt somewhere. Am I going to return it for cash? No.

I'm so perverse that I bother to install something like Hot Coffee, and I also don't personally thing Rockstar should be blamed for people hacking the game. It's like Someone hacking their copy of Windows only to find that they've opened up a backdoor that lets their computer be exploited and then trying to sue M$.

Gotta love Corporate America!
They should friggin' ban Barbie dolls and GI-Joe's because they can turn into sex toys if inserted into the various orifices of the human body!!! Hope no money-hungry lawyer reads this and sues Mattel or whatever... If by any chance any of them read this, I want 50%! :p

They should blame the ratings company who make crappy forms to be filled instead of testing the game!
THAT'S how you get your game rated today: BY FILLING A FORM! So 19th century... (they might do some "testing" like checking the box and manual for nipples!)

just like sex.... lol
I think this is goes in the wtf files for me... Like I'm going to spend time to go on line and find out when i bought that game, and what!?! I know it was the day before it came out, but i bought it few months before... so that leaves a lot to look into... now, if I'd only go through everything like they ask to get money and I'd be rich... Get a few every few months saying that I qualify for this or that settlement.. A load of bs...
IMO

ARe you kidding me? if you have an original disc, you could probably advertise the exploit on ebay and make $100

This will cost Rockstar too dear. Instead they should have said, "return your discs for replacement discs without explicit content" with maybe a $5 compensation. Afterall, nothing was sooo shockingly explicit considering the game was meant for grown-ups and explicit content is available but locked. So I don't see the logic in the $35 compensation.

I don't see the logic in about 90% of "obscenity" court cases in America today, so go figure.
